This policy describes the data collected via the https://1792avocats.com website, the purposes for which it is processed and the rights available to you.

2. Data collected

2.1 Data you provide to us

Via the contact form: the nature of your request (business or individual), your first and last name, your email address, your phone number, the subject of your request and the content of your message.

If you write to us directly by email or call us, we collect the contact details and information you choose to share with us.

Important: the contact form is not a secure channel. We ask that you do not include any confidential or sensitive information about your situation; such information will be gathered during an initial direct discussion with the firm.

2.2 Data collected automatically

As you browse, the server records technical connection data: IP address, date and time of the request, pages viewed, browser type and operating system. This data is necessary for the operation and security of the site.

Cookies and trackers may also be placed on your device under the conditions described in Article 7.

4. Mandatory nature of responses

The contact form fields marked as mandatory are necessary to process your request: failing which, the firm will not be able to respond to you. The other information is optional.

5. Data recipients

Your data is intended solely for the lawyers and staff of the firm handling your request. It is not sold, rented or exchanged for commercial purposes.

The following may access it, strictly within the limits of their duties, as the firm’s technical service providers acting as processors within the meaning of Article 28 GDPR:

  • the site’s host (see Article 6);
  • the provider responsible for the design and maintenance of the site, PUSH IT UP (124 rue d’Aboukir, 75002 Paris);
  • the firm’s email service provider.

Your data may also be disclosed to judicial or administrative authorities where required by law, in compliance with lawyer-client privilege.

6. Hosting and data location

The site is hosted by Hostinger International Ltd, 61 Lordou Vironos Street, Lumiel Building, 4th floor, 6023 Larnaca, Cyprus — www.hostinger.fr.

The data collected via the site is stored on servers located in France. As such, it is not transferred outside the European Union.

The site also uses fonts served by Google Fonts, the loading of which may trigger a connection to servers potentially located outside the European Union.

7. Cookies and trackers

A cookie is a file placed on your device when you visit the site. The site uses:

  • strictly necessary cookies for the operation of the site (security, display-language management, saving your cookie preferences). These do not require your consent;
  • audience-measurement cookies, intended to compile visit statistics. These are only placed after your consent has been obtained.

The collection and management of your consent are handled by the Complianz tool. You can accept, refuse or personalise your choice as soon as you arrive on the site, and then change it at any time from the cookie management banner accessible in the footer.

Your choice is kept for six months; once this period has expired, your consent is requested again. You can also set your browser to refuse cookies, it being specified that some site features may then be degraded.

8. Retention periods

  • Contact-form requests not followed by a client relationship: three years from your last contact.
  • Data of the firm’s clients: for the entire duration of the relationship, then five years from the end of the engagement, in accordance with the limitation period applicable to lawyers’ liability (Article 2225 of the French Civil Code), without prejudice to any longer statutory retention obligations.
  • Server connection logs: twelve months.
  • Cookies: a maximum of thirteen months for audience-measurement cookies, six months for saving your preferences.
  • Proof of consent: three years.

9. Security and confidentiality

The firm implements appropriate technical and organisational measures to protect your data against any destruction, loss, alteration, disclosure or unauthorised access: encrypted connection to the site (HTTPS), data access limited to authorised persons, regular platform updates.

The information you entrust to the firm in the context of a consultation or a matter is also covered by lawyer-client privilege, which is a matter of public policy, general, absolute and unlimited in time under Article 66-5 of French Law no. 71-1130 of 31 December 1971.

10. Your rights

In accordance with Regulation (EU) 2016/679 and amended French Law no. 78-17 of 6 January 1978, you have the following rights:

  • the right to access your data and obtain a copy;
  • the right to rectify inaccurate or incomplete data;
  • the right to erase your data, within the limits of the firm’s legal retention obligations;
  • the right to restrict processing;
  • the right to object to processing based on legitimate interest;
  • the right to the portability of the data you have provided to us;
  • the right to withdraw your consent at any time, without affecting the lawfulness of processing already carried out;
  • the right to set directives regarding the fate of your data after your death.

These rights are exercised by email to accueil@1792avocats.com or by post to the firm’s address, upon proof of identity. The firm will respond within one month of receiving your request, extendable by two months for complex requests.

The exercise of these rights is subject to the rules specific to the legal profession, in particular professional secrecy and the obligations to retain case files.

If, after contacting us, you consider that your rights are not being respected, you may lodge a complaint with the French data protection authority (CNIL):

The firm reserves the right to amend this privacy policy, in particular to take account of legal, regulatory or technical developments. The date of the last update appears at the top of the page. We encourage you to review it regularly.
